What I think the problem is is that the line "We hold that one who distributes a device with the object of promoting its use to infringe copyright, as shown by the clear expression or other affirmative steps taken to foster infringement, is liable for the resulting acts of infringement by third parties," (from Justice David H. Souter, as quoted by the NYT) leaves open the question of who and by what means will decide that there have been "affirmative steps taken to foster infirngement".

As someone else wrote, this is inviting a hailstorm of court actions against technology companies. Not exactly an atmosphere fostering innovation, I think.

I would not be so terribly pessimistic about today's ruling.

Basically the Court said if you make knives and sell them as "Ideal for stabbing that crooked business partner" you are potentially liable. But merely making knives remains entirely legal.

The media hysteria is all about people who have not read the decision carefully and want a headline.

The music and movie industries, so long as they see themselves in the distribution business, remain doomed.

Morpheus/Grokster Senate Ruling Explained

So what we have is a worldwide media industry that is watching its artificially maintained empire collapse and crumble as it lashes out at anyone and everyone in a desperate attempt to save something that doesn't exist in the form that it once did.
